Bienvenido a Tengo Peguita. Al descargar, acceder o utilizar nuestra aplicación móvil ("la Aplicación"), usted acepta estar sujeto a estos Términos y Condiciones de Uso ("Términos"). Si no está de acuerdo con estos Términos, no utilice la Aplicación.

1. Descripción del Servicio

Tengo Peguita es una plataforma que conecta a usuarios que ofrecen trabajos o "peguitas" ("Oferentes") con usuarios que buscan realizarlos ("Postulantes"). La Aplicación permite publicar ofertas, comentar en ellas y comunicarse a través de un chat integrado.

Tengo Peguita actúa únicamente como un intermediario tecnológico. No somos empleadores, agencias de empleo ni garantizamos la calidad, seguridad o legalidad de los trabajos ofrecidos, ni la veracidad de las ofertas o la capacidad de los usuarios para cumplir con los trabajos o realizar los pagos.

2. Cuentas de Usuario

Para utilizar ciertas funciones de la Aplicación, debe registrarse y crear una cuenta. Usted se compromete a:

• Proporcionar información precisa, actual y completa.
• Mantener la seguridad de su contraseña y aceptar la responsabilidad de todas las actividades que ocurran bajo su cuenta.
• Notificarnos inmediatamente sobre cualquier uso no autorizado de su cuenta.

Nos reservamos el derecho de suspender o eliminar su cuenta si viola estos Términos.

3. Contenido Generado por el Usuario (UGC)

Usted conserva los derechos de propiedad sobre el contenido que publique (textos, fotos, comentarios), pero otorga a Tengo Peguita una licencia mundial, no exclusiva y libre de regalías para usar, reproducir, modificar y mostrar dicho contenido en relación con el servicio.

Política de Contenido Prohibido:

Está estrictamente prohibido publicar contenido que:

• Sea ilegal, difamatorio, obsceno, pornográfico, indecente, acosador, amenazante, odioso o racialmente ofensivo.
• Infrinja derechos de propiedad intelectual de terceros.
• Promueva actividades ilegales o violencia.
• Contenga spam o publicidad no autorizada.

Moderación y Reportes:

• Tengo Peguita no tolera contenido objetable ni usuarios abusivos.
• Implementamos un sistema de moderación que permite a los usuarios reportar publicaciones y bloquear usuarios que violen nuestras normas.
• Revisaremos los reportes y tomaremos medidas, incluyendo la eliminación de contenido y la expulsión definitiva de usuarios infractores, dentro de las 24 horas siguientes a la recepción del reporte.

4. Suscripciones Premium y Compras

La Aplicación ofrece una suscripción "Premium" que otorga beneficios como publicaciones ilimitadas, postulaciones ilimitadas, eliminación de anuncios y soporte prioritario.

• Pago: El pago se cargará a su cuenta de Apple ID tras la confirmación de la compra.
• Renovación Automática: La suscripción se renueva automáticamente a menos que la renovación automática se desactive al menos 24 horas antes del final del período actual.
• Cancelación: Puede gestionar y cancelar sus suscripciones y desactivar la renovación automática en la Configuración de su cuenta de Apple ID después de la compra.
• Sin Reembolsos: No ofrecemos reembolsos por períodos de suscripción parciales o no utilizados, salvo lo requerido por la ley aplicable.

5. Publicidad

La versión gratuita de la Aplicación puede mostrar anuncios proporcionados por terceros (como Google AdMob). Al usar la versión gratuita, usted acepta la visualización de estos anuncios.

6. Exención de Garantías y Limitación de Responsabilidad

LA APLICACIÓN SE PROPORCIONA "TAL CUAL". NO GARANTIZAMOS QUE EL SERVICIO SERÁ ININTERRUMPIDO O LIBRE DE ERRORES.

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, TENGO PEGUITA NO SERÁ RESPONSABLE POR:

• DAÑOS INDIRECTOS, INCIDENTALES O CONSECUENTES.
• CUALQUIER LESIÓN, PÉRDIDA O DAÑO QUE SURJA DE LAS INTERACCIONES ENTRE USUARIOS (OFERENTES Y POSTULANTES). USTED ACUERDA QUE CUALQUIER DISPUTA ENTRE USTED Y OTRO USUARIO ES EXCLUSIVAMENTE ENTRE USTEDES.

7. Privacidad

Su privacidad es importante para nosotros. Consulte nuestra Política de Privacidad para entender cómo recopilamos y usamos su información.

8. Modificaciones

Nos reservamos el derecho de modificar estos Términos en cualquier momento. Le notificaremos sobre cambios significativos a través de la Aplicación. El uso continuado de la Aplicación después de los cambios constituye su aceptación de los nuevos Términos.

Welcome to Tengo Peguita. By downloading, accessing, or using our mobile application ("the App"), you agree to be bound by these Terms and Conditions of Use ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

Tengo Peguita is a platform that connects users offering jobs or "gigs" ("Offerors") with users seeking to perform them ("Applicants"). The App allows users to post offers, comment on them, and communicate via an integrated chat.

Tengo Peguita acts solely as a technological intermediary. We are not employers or employment agencies, nor do we guarantee the quality, safety, or legality of the jobs offered, the truthfulness of the offers, or the ability of users to complete the jobs or make payments.

2. User Accounts

To use certain features of the App, you must register and create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or delete your account if you violate these Terms.

3. User Generated Content (UGC)

You retain ownership rights to the content you post (text, photos, comments), but you grant Tengo Peguita a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the service.

Prohibited Content Policy:

It is strictly prohibited to post content that:

• Is illegal, defamatory, obscene, pornographic, indecent, harassing, threatening, hateful, or racially offensive.
• Infringes on third-party intellectual property rights.
• Promotes illegal activities or violence.
• Contains spam or unauthorized advertising.

Moderation and Reporting:

• Tengo Peguita does not tolerate objectionable content or abusive users.
• We implement a moderation system that allows users to report posts and block users who violate our rules.
• We will review reports and take action, including removing content and permanently banning infringing users, within 24 hours of receiving the report.

4. Premium Subscriptions and Purchases

The App offers a "Premium" subscription that provides benefits such as unlimited posts, unlimited applications, ad removal, and priority support.

• Payment: Payment will be charged to your Apple ID account upon confirmation of purchase.
• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Cancellation: You can manage and cancel your subscriptions and turn off auto-renewal in your Apple ID Account Settings after purchase.
• No Refunds: We do not offer refunds for partial or unused subscription periods, except as required by applicable law.

5. Advertising

The free version of the App may display ads provided by third parties (such as Google AdMob). By using the free version, you agree to the display of these ads.

6. Disclaimer of Warranties and Limitation of Liability

THE APP IS PROVIDED "AS IS". WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENGO PEGUITA SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
• ANY INJURY, LOSS, OR DAMAGE ARISING FROM INTERACTIONS BETWEEN USERS (OFFERORS AND APPLICANTS). YOU AGREE THAT ANY DISPUTE BETWEEN YOU AND ANOTHER USER IS SOLELY BETWEEN YOU AND THEM.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect and use your information.

8. Modifications

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App. Continued use of the App after changes constitutes your acceptance of the new Terms.
